Over fifty years ago the constitution was implemented on December 25, 1947. A basic study on the current constitution is necessary as reference for the amendment or establishment of the constitution. Although the societal emphasis is on the standards on governmental system and protection of human rights, the economic articles related to the national economy and the livelihood of the people are needed to be examined with suggestions for improvement. This study conducts an examination through critical literature, globalization trend, constitution comparisons of selected countries, and views of economic experts on the constitution. Regardless liberalization or deregulation, it is inevitable for the government to withdraw from being a main component in the free economy. Taiwan’s economy is traveling down a rough path of liberalization. According to the globalization trend, the speed of total liberalization should be increased. Articles on economics should be amended since they are totally outdated. There are three levels to take into consideration. The first level is that despite the constitution was not in effect for a number of years, Taiwan economy developed well, and then does it mean that the constitution is irrelevant? The second level is that even if the constitution is needed, it is sufficient for articles to be on just non-related to economics such as safeguard of human rights, maintenance of people’s freedom, and limitation of government jurisdiction. No articles on economics in the constitution, just subscribes through common laws. The third level is if both of those previous levels are difficult to achieve, thus only through the use of “neutral policy” and “economic freedom” as the basic principles, allowing “necessary restriction” exception to repair the national economics articles in the existing constitution.
