Establishment of National Land Use Planning Review Committee and Public Participation Mechanisms for National Land Use Plan and Land Use Permit Systems

Abstract:

To elucidate the establishment and the context of the national land use planning review committee and public participation mechanisms for national land use plan and land use permit systems and to comply with related laws and regulations, this project collects tasks and goals , organization composition, principles for avoidance of conflicts of interest, operational mechanisms or patterns, similar committees or review boards and examines the rationale and comprehensiveness. The advantages/disadvantages and feasibility of different approaches to drafting the three level review committee s (the Executive Yuan, the Ministry of the Interior, and Municipalities and Cities/Counties) are also examined. Furthermore, the draft of the Establishment Code of the National Land Use Review Committee of the Ministry of the Interior and of Municipalities and Cities/Counties is also proposed. To enhance the public participation procedure of national land use plans, according to the regulations of articles 25, 27, 31 and 34 of the National Land Use Act, this project explores the context of public participation and procedure of national land use plans regulations Similarly, this project explores the context of public participation and procedure of national land use permits administrative sanction ) according to articles 25, 27, 31 and 34 of the National Land Use Act. Moreover, this project elucidates public participation methods in countries of UK, Germany, Japan, and US and Taiwan's National Regional Plan and urban plans. Through seminars and working group discussions with scholars, experts, NGOs and administration representatives, this project proposes preliminary public participation mechanisms, including the content, participation procedures and methods, freedom of information methods, formats and adoptions of opinion appeals, regulations of the meeting s and other related issues. Moreover, the draft of the Processing Rules for Dealing with Opinion Appeal s from the Public Display and Public Hearings for Land Use Permit is also suggested to provide references when drafting follow up laws and regulations and practical implementation for municipalities , cities and counties.
